Speeding tractor trailer leads to impaired driving and drug charges

Ontario Provincial Police received a complaint from a concerned motorist regarding a transport truck that was being driven in an erratic manner westbound on Hwy 401 in the Kingston area on Saturday.

Shortly afterward, an officer from the Lennox & Addington County detachment located the suspect vehicle travelling through Loyalist Township. In Ontario, commercial motor vehicles are required to be equipped with a speed governor that limits the speed of the vehicle to a maximum of 105 km/h. At the time that the vehicle was observed, a radar speed reading of 114 km/h was obtained from the vehicle.

The officer initiated a traffic stop of the truck and while speaking with its driver, determined that the person’s ability to operate a motor vehicle was impaired by a drug. Subsequent testing by a drug recognition expert confirmed the impairment. In a search incident to the arrest, police located in excess of 250 methamphetamine pills with an estimated street value of roughly $6,325.

A 66-year-old from Kitchener, is charged with:

  • Operation of a motor vehicle while impaired;
  • Operating a motor vehicle while the concentration of a drug in their blood exceeded the legal limit, both contrary to the Criminal Code; and
  • Possession of a Schedule I substance, contrary to the Controlled Drugs and Substances Act.

The accused was released from custody and is scheduled to appear in the Ontario Court of Justice in Greater Napanee on May 26. The vehicle they were operating was seized and has been impounded for a period of 7 days.

-Monday morning at approximately 3:00 a.m. Officers of the Lennox & Addington (L&A) County Detachment of the OPP were on general patrol and observed a vehicle driving in an erratic manner on Highway 401 eastbound near the Greater Napanee exit.  Police initiated a vehicle stop and determined that the driver did not have a licence.  The driver was arrested for driving without a licence and police determined that drugs were in the vehicle.

All three occupants were subsequently arrested for possession of the drugs.

A 59-year-old of Scarborough is charged with:

  • Possession of a Schedule I substance contrary to the Controlled Drugs and substances Act
  • Driving while under suspension contrary to the Highway Traffic Act of Ontario.

A 37-year-old of Scarborough is charged with:

  • Possession of a Schedule I substance contrary to the Controlled Drugs and Substances Act
  • Obstructing a peace officer, contrary to the Criminal Code.

A 33-year-old of Scarborough is charged with:

  • Obstruct peace officer
  • Assault peace officer both contrary to the Criminal Code
  • Possession of a Schedule I substance contrary to the Controlled Drugs and Substances Act.

All three accused were released on an undertaking and are scheduled to appear at the Ontario Court of Justice in Greater Napanee on June 2.
